Build the first account around the exact place
A street address, cross street, property entrance, floor, trail, platform, or pickup point is more useful than a broad neighborhood name. In Fairmont, first note where the injury happened, who was present, and who made a report. For a traffic collision, save the report number, vehicle and insurer details, trip records if a hired ride was involved, and original photos. For a fall in a store, restaurant, hotel, or parking area, record the precise spot, condition you observed, witnesses, and any report to staff. The fact that an injury happened at a place does not by itself establish legal responsibility.
Schools, parks, sidewalks, and public buildings call for an additional question: who owned or controlled the exact location? A Fairmont or West Virginia agency, school district, private operator, property owner, or contractor may have different duties and procedures. If an animal was involved, preserve the owner’s identity, medical records, witness details, and any animal-control contact. These facts help a lawyer identify what to investigate.
Before you call, separate what you saw from what someone else told you. Make a short timeline of medical care, missed work, and insurer contact, then save the original messages and documents. Ask the firm which records it would obtain itself and whether any camera footage, vehicle data, or school records should be preserved quickly. You do not need to decide who was at fault before speaking with a lawyer; a focused account of the known facts is more useful than a conclusion.

Photograph the exact feature if safe, identify the address or facility area, record weather and lighting, find witnesses, and note the agency or contractor that received a report. Public ownership does not itself establish liability and may trigger special procedures.
The first investigation should also test who controlled the site, vehicle, animal, equipment, or activity and which records exist in Fairmont. Preserve what you have without editing originals. If a West Virginia public body or public school may be involved, ask about immunity and claim-notice procedures immediately.
West Virginia rules to raise early
W. Va. Code § 55-2-12 provides two years for the category summarized here. Accrual rules, tolling, minors, medical claims, wrongful death, claims against public bodies, and other exceptions can change the calculation. Treat the citation as a prompt for a lawyer, not a filing calendar.
West Virginia generally applies this fault principle: modified comparative fault generally bars recovery when claimant fault is greater than the combined fault of all other persons responsible. The result depends on the causes of action, responsible parties, proof, and current law. Dog bites can be governed by statutes, common law, local ordinances, or more than one theory. A public school, city, county, transit agency, or state body can introduce immunity, claim-presentation, or notice requirements. Ask counsel to identify the exact entity and current procedure promptly.

Compare lawyers for this particular incident
Ask each firm whether it currently handles the relevant type of case in West Virginia. For a collision, ask how it investigates disputed fault and preserves vehicle or trip records. For a dog bite, ask which elements and defenses the applicable dog-injury rule requires. For a public place or school, ask about experience identifying the right public entity and checking notice requirements. A firm that handles one injury category may not handle all of them.
Also ask which lawyer will supervise the work, who will contact you, how often you can expect updates, and what happens if the firm declines the case. Request written terms covering the fee, expenses, any termination provision, and what you might owe if there is no recovery. A directory profile is not an endorsement or a promise that a firm will take your case.
